TERMS OF USE

The Terms of Use constitute a legally binding document regulating the relationship between the website user and the website owner. By using the retail or wholesale section of the platform, the user confirms they are familiar with these Terms and accept them in their entirety. If the user does not agree with any part of the Terms, they are obliged to immediately stop using the website.

Website Access and User Types

The website consists of two separate segments: the retail section, available to all visitors, and the wholesale section, accessible only to registered business users after access has been granted.

The retail section is intended for natural persons wishing to make an online purchase. Access is free and does not require registration, except during order completion when data necessary for delivery is provided.

The wholesale section operates as a catalog without displayed prices and without the possibility of direct purchase. Access is restricted and granted exclusively by the owner after prior communication and business identity assessment. Any unauthorized attempt to gain access will be treated as a violation of the terms of use.

Accuracy and Availability of Information

All products, photographs, material descriptions, technical specifications, and other information displayed on the site serve as informative content. The website owner strives to ensure information is accurate and up-to-date but cannot guarantee complete error-free operation or continuous availability of the platform.

In the textile industry, natural variations in color, texture, or material shades may differ compared to the display on the user's screen. The owner reserves the right to make corrections to information without prior notice.

Online Purchase

In the retail section, the purchase agreement is considered concluded the moment the user confirms the order and the system generates an order confirmation. The user is obliged to enter accurate data to enable delivery. Incorrectly entered data may lead to delays or inability to deliver, for which the website owner bears no responsibility.

Product prices are listed in Dinars (RSD), including all prescribed taxes. In case of technical errors in price display, the owner reserves the right to cancel the order while notifying the user before delivery.

The wholesale section does not enable purchases. Offers, prices, quantities, and terms of cooperation with wholesale partners are formed exclusively through individual communication and do not constitute publicly available information.

Website Usage Restrictions

Users are prohibited from using the website in a way that may cause damage, disrupt the platform's operation, compromise security, or threaten any third party. Unauthorized copying of photographs, texts, or any copyrighted material published on the site is also prohibited unless otherwise permitted.

Liability and Warranties

The website is used solely at the user's own risk. The owner is not responsible for eventual technical failures, temporary unavailability of the platform, inaccurate information resulting from technical errors, or consequences arising from incorrect data entry by the user.

Regarding products, the owner is liable in accordance with applicable consumer protection laws, warranties, textile product quality, and complaint terms. Quality warranties apply exclusively to technical material characteristics and the compliance of delivered goods with the specifications given in the product description.

Wholesale User Accounts

Users granted wholesale access are responsible for safeguarding their login credentials and for all activities conducted under their accounts. The owner may, without prior warning, terminate access for any user who violates the Terms or misuses confidential information.

The user may request account deactivation at any time, unless there are unresolved obligations or open offers in progress.

Copyright and Intellectual Property

All visual and textual content, including material photographs, packaging design, graphic solutions, product descriptions, and all other creative elements, constitute the intellectual property of the website owner or third parties who have granted usage rights. Partial or complete copying, distribution, or commercial use of content without explicit approval is prohibited.

Changes to the Terms of Use

The owner reserves the right to, at any time and without prior notice, amend the Terms of Use, website structure, or platform functionalities. Any amendment will be clearly published on this page and applicable from the moment of publication.

Continued use of the website shall be considered as the user's consent to all changes.

2.1.3. Currency conversion statement

All payments will be effected in Serbian currency – dinar (RSD). The amount your credit card account will be charged for is obtained through the conversion of the price in Euro into Serbian dinar according to the current exchange rate of the Serbian National Bank. When charging your credit card, the same amount is converted into your local currency according to the exchange rate of credit card associations. As a result of this conversion there is a possibility of a slight difference from the original price stated on our website.

2.1.5. Delivery of goods and limitations

Products are delivered via courier services with whom we have a contract. Delivery time depends on the destination and usually ranges from 1 to 5 business days, except in cases of delays beyond our control (e.g. extreme weather, public holidays, courier service issues). Shipping costs are displayed before checkout is completed.

Billing method: after order confirmation, the customer is redirected to the secure Banca Intesa ad Belgrade page to enter card details. Funds are reserved on the card account (PreAuth), and the final charge (capture) is processed only after the merchant confirms and processes the order.

Online sales and delivery are performed within the territory of the Republic of Serbia, unless otherwise stated on the product page or during checkout. If delivery outside Serbia is requested, the customer must comply with applicable customs, tax, and other regulations of their country. The merchant is not responsible for customs duties, import restrictions, or other regulations affecting delivery to end users outside our standard delivery area.

2.1.6. Complaints policy

Customers have the right to file a complaint in accordance with applicable consumer protection laws. A complaint may be submitted via email, the contact form on the website, by phone, or in writing to the merchant address, together with the order number and a description of the issue.

The merchant confirms receipt of a complaint within eight (8) days and responds within fifteen (15) days. Depending on the nature of the complaint, the customer may be entitled to repair, replacement, price reduction, or refund in accordance with the law.

The customer may withdraw from the purchase within fourteen (14) days of receiving the product, without giving a reason, provided the product is unused, undamaged, and in its original packaging. Return shipping costs are borne by the customer unless the return is due to the merchant's error.

2.1.7. User privacy protection

On behalf of Exspace Commerce, we undertake to protect the privacy of all our customers. We collect only the necessary basic customer/user data and data required for business operations and customer communication in accordance with good business practice and for the purpose of providing quality service. We give customers a choice, including the option to be removed from mailing lists used for marketing campaigns. All customer/user data is kept strictly confidential and is available only to employees who need it to perform their duties. All Exspace Commerce employees (and business partners) are responsible for complying with privacy protection principles.

2.1.8. Protection of confidential transaction data

When entering payment card data, confidential information is transmitted over the public network in protected (encrypted) form using the SSL protocol and PKI system, as the most up-to-date cryptographic technology. Payment card data security during purchase is guaranteed by the payment card processor, Banca Intesa ad Belgrade, so the entire payment process is carried out on the bank's pages. At no point are payment card details available to our system.

2.1.9. Refund of funds

In case of order cancellation or product return, refunds to customers who paid by card are processed exclusively via VISA, EC/MC, Maestro, Amex, and Dina payment methods, i.e. exclusively to the payment card account by reversing the original transaction.

In case of product return and refund to a customer who previously paid by card, in part or in full, regardless of the reason for return, Exspace Commerce is obliged to process the refund exclusively via VISA, EC/MC, Maestro, Amex, and Dina payment methods, meaning the bank will, at the merchant's request, refund the funds to the cardholder's account.
